Professional filing of Form DPT-3 with the Registrar of Companies (ROC) for reporting deposits and/or outstanding receipts of money or loans under the Companies Act, 2013.
Form DPT-3 is a statutory e-form required to be filed by eligible companies with the Registrar of Companies (ROC) pursuant to Rule 16 and Rule 16A of the Companies (Acceptance of Deposits) Rules, 2014, framed under Sections 73 to 76 of the Companies Act, 2013.
The form is used for filing:
(i) the Annual Return of Deposits,
(ii) the Return of Outstanding Receipt of Money or Loan not considered as Deposits, or
(iii) both, as applicable.
Most companies having outstanding loans, advances, inter-corporate borrowings, security deposits or other exempted receipts as on 31st March are required to file Form DPT-3, even where such amounts are not treated as deposits under the Companies (Acceptance of Deposits) Rules, 2014.
The form must generally be filed on or before 30th June of every financial year, reporting the outstanding position as on 31st March. Non-compliance may attract additional filing fees under Section 403 of the Companies Act, 2013, along with penalties under the applicable provisions of the Act.
Our professionals assist in determining applicability, reviewing outstanding borrowings, classifying exempted receipts, preparing Form DPT-3, validating attachments, associating Digital Signatures (DSC) and completing successful filing on the MCA V3 Portal.
